Agreeing to these terms
These terms cover your use of the Pelham Concrete website and any estimate or concrete work you get from us. By using the site, asking for an estimate or booking a job, you agree to them, so if you don't agree, please don't use the site or book work with us.
Pelham Concrete is a concrete contractor in Pelham, AL. "We," "us" and "our" mean Pelham Concrete and our crew, and "you" means the person using the site or the property owner we're working for.
If a signed estimate or contract for your job says something different from these terms, the signed document controls for that job.
What we do
We pour and repair concrete for homes and businesses in Pelham and the cities around it, including driveways, patios, sidewalks, steps, slabs, foundations, retaining walls and concrete cutting. You can read more about our crew on our About page and see the full list of services from our home page.
The service descriptions on this site are general. The exact work for your property, including the size, thickness, finish and materials, is set in your written estimate.
Estimates and pricing
Our on-site estimates are free and come with no obligation. An estimate is based on what we can see on the day we visit, so it covers the work, materials and conditions written on it.
Once the old concrete is out, we sometimes find things nobody could see beforehand, such as soft or wet subgrade, which is the ground the slab sits on, buried debris, roots or a second layer of old concrete. If that happens, we'll stop, show you what we found and get your okay before doing any extra work that changes the price.
Changes you ask for after the estimate, like a larger area or a different finish, are priced separately. Material costs move, so an estimate is good for the period written on it.
Scheduling, weather and cancellation
We give you a start date when you book, but concrete depends on the weather. Rain, freezing temperatures or extreme heat can push a pour back, because pouring in the wrong conditions makes a weaker slab, and we won't do that just to hit a date.
New concrete needs time to cure, which is the wait while it hardens and gains strength, before you walk or drive on it. We'll tell you how long to wait for your job, and damage from using the slab too early isn't covered.
If you need to cancel or reschedule, call us as soon as you can at (205) 651-8545. If we've already ordered materials or built forms for your job, you may owe for those costs as your estimate or contract explains.
What we need from you
Before we start, you agree to give our crew safe access to the work area, move vehicles and belongings out of the way, and tell us about anything buried that we might not know about, such as sprinkler lines, septic parts or private wiring.
Unless your contract says otherwise, you're responsible for confirming property lines and getting any homeowners association approval. Permit rules differ from city to city, so check with your city's permit office about whether your job needs one.
Concrete trucks and equipment have to reach the pour site. We work carefully around your yard, but some wear to grass and landscaping along the access path is normal and isn't something we repair unless your contract says so.
Payment
Your estimate or contract sets out any deposit and when the balance is due. Unless it says otherwise, the balance is due when the work is finished.
If a payment is late, we may charge interest and collection costs as Alabama law allows, and we may file a lien on the property for unpaid work where the law permits it.
Cracks and how concrete changes over time
Some hairline cracking is normal even on a well-built slab, because concrete shrinks as it dries and the ground under it moves with the seasons. We cut control joints, which are planned grooves that give the slab a place to crack in a straight line, but no contractor can promise a slab that never cracks.
Color can vary from one pour to the next, and new concrete won't match old concrete exactly. Wear from de-icing salt, chemicals, loads heavier than the slab was built for, drainage changes made after we leave, or tree roots isn't a defect in our work.
Warranties
We want you satisfied with every job, so if something we did doesn't look right, call us and we'll come out and look at it. Any written warranty for your job, and what it covers, will be in your estimate or contract.
Apart from that written warranty, and as far as Alabama law allows, we give no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
The information on this website is general and provided as is. It isn't advice for your particular property, and we don't promise it's complete or up to date.
Limits on our liability
As far as the law allows, Pelham Concrete isn't liable for indirect, incidental or consequential damages, such as lost use of a driveway, lost income or harm from conditions we didn't create and couldn't reasonably see. Our total liability for any claim about a job is limited to the amount you paid us for that job.
We aren't responsible for damage to buried lines or features that weren't marked and that you didn't tell us about. Nothing in these terms limits any liability that Alabama law doesn't allow us to limit.
Settling a disagreement
If you have a problem with our work or a bill, call us first, because most issues get sorted out with a conversation and a visit to the site. If that doesn't settle it, we both agree to try mediation in good faith before either of us goes to court.
Any lawsuit about these terms or our work will be brought in the state or federal courts serving Shelby County, Alabama.
Governing law
These terms and any work we do are governed by the laws of the State of Alabama, without regard to its conflict of law rules.

We may update these terms from time to time, and the version posted on this page applies from the day we post it. Changes don't affect a signed estimate or contract that's already in place.
